Eligibility criteria

To prevent the misuse of the refugee program, there is a strict screening program that one must qualify for. At MJS Immigration we sort out the eligibility criteria right at the beginning of the consultation, so that we can offer possible alternatives in case of inadmissibility due to disqualification based on this criteria.

To qualify as a refugee, the individual must fall under any one of the following categories:

  • Convention refugee abroad class

Any person who is outside their home country and cannot return due to a well-founded fear of persecution (based on their race, religion, nationality, political views, sexual orientation) is considered to be a part of this category. These individuals can be sponsored by the Government of Canada, private sponsors or both.

  • Country of asylum class

Any individual who is outside their home country or the country they normally live in has been seriously afflicted by civil war/armed conflicts and denied basic human rights is eligible for protection through the asylum class.
